Phew!! well F2F over and done with ... No time to send & wait on response of letter to DWP demanding to know why not transfered to ESA via exsemption.. so put in a copy along with evidence at the F2F..

Horrendous:

Thankful for there being a out of hours doctors service, as in the evening required treatment from them after attending this F2F conducted by an ex nurse
It went as well as could be expected, even though this ex nurse kept blaming the DWP for my being there, it was made obvious she believed in this current system and there is no reason for the disabled not to be working.

She more or less stuck to the script, but constantly repeated herself on certain questions regarding hobbies and watching tv, jumped on one carer being sporadic, as in a part time carer, like a dog with a bone, even though it was made clear am attended by two full time carers & a part time backup carer ( if that appears on the report the wrong way round it may well have to be challengend)


Interesting:

Part of the questioning revolved around these future private companies being set up who will be sign posting the disabled towards reablement groups/workshops before having direct access to social services.

Where to please are the copies of template letters to request the reports.
Stll feeling far to done in to go looking about, thanks.

Well at least it is over :)

There is no template letter for requesting the report, just phone the DWP office dealing with your claim and ask to be sent the ESA85, we do advise following up the request in writing but your letter just needs to be a copy of what you have said on the phone.

Our experience with ESA is that the report will not be sent until after the Decision Maker has made a Decision.

:blush: :blink: Well some bright spark at the DWP has made a decision & seen fit to award ESA SG .. No seriously it's refreshing!!!

But only for 12 months :angry: :ohmy:

Thanks to B&W for the guides & you! the mod team for all your learned knowledge.
Without all this extra help even I would be stumbling about in a darkened forest that is this new extreme right wing ideology welfare system..

Have requested the ESA85 report.

Weighing up the options of having again to go through, next March, all this utter nonsense Or to ask for a longer award .. erring on the side of caution ! besides being emotionally & mentally dilapidated and drained, the possibility of a DM lowering the award time would be devastating .
Oh I despise being help to ransom !!

Anyways guys some good news to a point!

Now onwards and upwards soon enough will be the PIP battle :evil:

Congratulations on The SG Award !! :cheer:

Thanks for your very kind comments regarding "all" at B&W ! :)

Even if you wanted to, you could not challenge the "length" of the SG award.

Unlike PIP and DLA before it, that have fixed term awards where the length of the fixed term can be challenged, ESA is actually an indefinite award, in theory, which is liable to regular periodic reassessments.

The "recommended" length of the award (The Prognosis) is just that, a recommendation, and is therefore not open to challenge.

How often will I be reviewed

So who makes this Recommendation the maximus Hcp? the DWP DM?
Joint effort?
Now I requested the ESA85 will there be details on there as to why a 12month re-assessment is recommended ?
I was told over the phone I will be getting another ESA form around March.

Basically I want to know who, how and why this 12 moths recommendation came about.

Hi c6,

The Assessing HCP makes the recommendations regarding the length of the prognosis in The ESA85 medical report.

The DWP DM then decides whether or not to stand by the recommended prognosis.

In reality the DM does generally stay with the recommended prognosis.

This will then be placed on your ESA File, and a month or so before that date it will flag up.

You would then be re-referred back to Maximus who should issue a fresh ESA50.

There is information on how The HCP should decide on the prognosis period from the bottom of page 137 onwards of The WCA Handbook under the heading 3.10 Medical Advice on Prognosis at Assessment
