Thanks for that, it is much appreciated. There seems to be no definitive answer. Anything I have read states neither a straightforward 'yes' or 'no' but instead uses the word 'may' be able to export.... without further explanation!!

In another post I note that the exportability of Dla and Pip to the EU( which would include the Irish Republic) has been stopped, is that a definite?

Thanks in advance, as I'm not sure if I should be discussing this on the forum and apologize if that is the case..

The DWP seem to be a law unto themselves.

The EU should be an area of reciprocity anyway. As such you either take your benefits or get their equivalent.
However it always seems that EU rules that we don't want get enforced and ones which would benefit us get obstructed or opted out of.

In any case someone would need to go to the ECJ to enforce EU rules over UK which should be relatively straightforward as the UK is just pandering to an outrage it has drummed up using its poodle press to spotlight so called scroungers and dossers milking the system living in luxury on the med at hard working taxpayer expense.

Maybe you could be that person.

Yes you are right it is all very confusing.

We had an exportability aspect built into my IB/DLA,and it was signed off by the Secretary of State, however with ESA/PIP these benefits were deemed not exportable as one has to be regarded to be able to have re assessments in the UK only, and as these benefits as we know are open ended, it could mean being assessed every 3 months and not at the same time !!!

I did not opt to go abroad as I had second thoughts at the last moment and subsequently ESA was introduced. As we know this is not exportable. However it seems that if someone did take it further with the help of a freebie lawyer to open up the position it may work. But if anyone did so they would be deemed fit for work as it would take a lot out of you.

So in all tense and purpose non of the benefits are exportable.

How did this subject pan out? We have been unable to find definitive answers anywhere and even though the law states our payments should continue, in reality people report major issues.
