I think I could explain my problems well, trouble is my contamination phobia/OCD is so bad it may look like I am making it up lol. If they were to reject my claim immediately and not even call me for a Maximus assessment, would I be able to have another attempt at claiming in the future by which point I may have more evidence

If you make a Contributions only claim and it is rejected then you can immediately make an Income Related claim.

If you are found Fit for Work, whatever the basis of your claim, then although you can make a new claim for ESA you will not be paid on it until a Decision is made unless you can show that you have a new conditions or there has been a deterioration in your conditions since the original claim was made.

I think what has confused us is that you mentioned Maximus in your query :

The Centre for Health and Disability Assessments (CHDA) (aka HAAS) (Maximus) who took over the ESA WCA Contract from ATOS on 02/03/15 only carry out ESA Asessments/Reassessments.

ATOS and/or Capita carry out PIP Assessments.

If your PIP Claim failed, besides your normal MR/Appeal rights, you could make a fresh PIP Claim immediately.

Or, you could MR/Appeal the adverse PIP Decision and make a fresh PIP Claim at the same time.

Entitlement to PIP is not dependent on your NI Contribution record/history, nor is it means tested.

People in full time employment can also be awarded PIP !

Totally different rules and qualifying criteria to ESA !!

oh sorry, thought Maximus was for PIP too, can see why I am causing confusion! Keeping you all on your toes though lol ;) Thank you for all the info, I shall study it all now :)
