Well done for taking charge of this and getting to a place where you feel calm! I'm glad to hear that Motability have been helpful.

Me too I felt horror and relief both at the same time as the time waiting and the dread an sickness in the puit of my stomach every time the psot arrived. Unfortuantely I got PIP and WCAS both at the same time (I am on ESA support group) I was ill with a virus at the time and when the form came after the phone call (two weeks later) it gave me no time to complete PIP form and ESA. Now its turning into a nightmare. I provided loads of medical evidence which seems to have gne agaisnt me. First an appintment for a face to face conulstantion (despite me asking for a home vist and having a letter from a psychaitrist requesting one and reasons why) Then they cancelled it and said they would assess me on paper and now they have changed their minds and assessment back on! They said on the phone they dispute I have agrophobia (what pyschiatrist puit) as I admitted to them on the phone I attend hopstal appoinments but I use patient transport and have someone with me. I am terrified of going out and cannot be around people. They refuse me a home visit as theys aid I put on my form I get angry(with myself) but for health and safety and to potect their staff I ahve to go for face to face. |I am on DLA and frightened now I will lose anything and I dont want to go on. I ve had enough of such a miserable excuse of an exisitance.

Received the MR decision, less than six weeks after applying, and predictably it's an endorsement of the original decision. What a waste of my, and their, time. Despite me pointing out the errors, omissions and inaccuracies within the HP's report the DM has dismissed it with a brisk "I have no reason to doubt their [HP's] findings".

And so it's now on to an appeal. I shall be posting my application this week.

I know it's been said many times before but the Mandatory Reconsideration part of this whole process really is a complete and utter waste of time. If I were to be cynical, and I am, I would say it's designed solely to stall and intimidate claimants and whilst I'm sure that it does that for some the fact that so many decisions are overturned at appeal suggests that it's not working.

I am hoping that the appeal hearing will give me the chance to have the assessment that I should have had in the first place!

After getting my appeal application off I intend to complain to ATOS about the conduct of their assessor. For all the good that will do me!

Saga update.

Confirmation received from Appeals. They say they have asked DWP to respond who will send me a copy of their response. That should be interesting (!)

Unfortunately haven't had the energy to do my ATOS complaint yet.

LATEST:
DWP replied just at the deadline date. Nothing new, they simply re-iterated what they had already said, i.e. We have no reason to doubt the HP's account/recommendation thus implying that I am a liar.

I know that some people will obviously lie/exaggerate and therefore have no problem with having an assessment but so many assessments are not done properly hence the high number of appeals and the high success rate of those appealing.

A few days later and I received my appeal date, 13th December. Will update after my appeal.
