It's a DWP internal document used by Decision Makers to document why they have made a Decision on an ESA claim, it's definitely used for transfers from another benefit to ESA, but it's unclear when it is used for reassessments.

Is it possible to request a copy of this document via a subject access request?

Sorry I must of missed that.

I was told a few months ago that my ESA would be reviewed in August 2016.

I rang the DWP twice this week regarding this issue. I spoke to an agent in Makerfield who took me through security on Tuesday and when I asked her whether the questionnaire had been sent she relied saying that I am in the support group and won't be re-assessed until 2018.

After I got off the phone I remember yourselves saying that the maximum award in SG is 3 years so I smelt a rat.

I rang again today and the operator in Southend put the record straight and my award ends in Aug 2016. When I asked whether the questionnaire has been sent she said no. When I asked what happens if it gets lost in transit she said a reminder is sent.

I am worried they won't send me the questionnaire - either not at all or they will delay sending it.

What sort of time scales should I give them re: chasing the questionnaire. I understand legally they don't have to send out the document - is that correct?

Kind Regards

It's possible that the call centre staff will have limited visibility of where you are in the assessment process.

As the time approaches, the DWP will send your file to Maximus and it will be them who send out the ESA50 and any reminder letters, you should contact them about what is happening.

You are right that there is no legal requirement for an ESA50 to be issued, but it is rare for one not to be sent.

I would chase them about once a fortnight in the near term and more frequently in August.
