hi Gordon ,you mentioned in a previous answer ,that because i have been placed in wrag they understand i have genuine medical problem ,because of this would it be safe to say that i do not need to send copies of my xrays ,mri`s etc with the reconsideration team

If you have sent them before as part of this assessment then you do not need to send them again, if they have not been sent then you need to consider what you are trying to prove with this information remembering that the Decision Maker is not medically trained although they will have access to medical advice?

You need to remember that this is medical evidence, it may directly show limitations that are applicable to the ESA Descriptors, it may imply limitations which will require acceptance that they are valid, but is also possible that there will be no direct correlation. Only you can decide which of these are applicable to each piece of evidence.

well Gordon just sent my reconsideration letter away ,wrote 10 pages of reasons why i thought the medical assessor had not given me the correct points ,a letter from my doctor backing up my info and just for good measure a letter from my local MLA lol will keep you posted how it goes ,although it could take some time as i had a telephone call from the reconsider team last week when i requested further medical evidence ,that at the minute all support reconsiderations are on hold as their legal team get clarifacation on "the substantial risk " element

hi Gordon ,just remembered something from medical,is it possible for the assessor to use info from a previous ESA50 form ,as a question she asked me about was on a previous form and not on the new one i had filled out previous to medical taking place ,if so why would they do this if they had all the up to date info on the new ESA50

It would be unusual for them to look at a previous claim form, but they do have the facility to do this. Why they might do this will depend on what the "question" was.
