hi cazzy ,
if i could ask also ,after sending in the MR how long dd it take for you to hear back from them ,it only been 2 weeks since sending mine and by reading forums on here seems theres no actual time scale either ,
Hi Alison,
There is no time scale no. In my case my deadline was 18 May and they'd written back by 29 May - which makes me further suspect they were just waiting for deadline then went ahead without giving my lengthy MR any consideration.
I started trying to formulate my appeal yest but got overwhelmed after an hour after trying to read all the guidance notes - i cant go through an appeal in person - most i will try is paper. And reading that DWP can still object to it even being submitted! or can insist i do turn up in person. i have little hope any of it will make a difference - i am fighting a loosing battle...and the joke is im more unwell now then i have ever been and having to fit this around medical appointments - the same medical appointments that made me unemployable due to the amount of time off! anyway. we shall see.

Providing your appeal is requested within one month from the date of the MR the DWP cannot contest your request.

Hi Gordon, it says on justice.gov.uk website guide form they can:
hmctsformfinder.justice.gov.uk/HMCTS/Get...?court_forms_id=3038
Leaflet name: How to Appeal Against a Decision Made by the Department for Work and Pensions.
Page 18:
Objecting to the appeal
DWP also has the right to object to your appeal if they are of the opinion that there is a defect in your appeal for some reason. This will generally be because they believe HMCTS may have overlooked something and accepted an appeal which DWP think is not valid. DWP can object to an appeal for a number of reasons, but the main ones are:
• Because it is against a decision which does not carry a right of appeal
• Because it is late and the reasons for lateness are unreasonable
• Because it does not have enough information to identify the decision or give grounds for appeal
• Because it has no reasonable prospect of success
...it goes on

This would be if your appeal is requested for improper reasons, if you follow the guide then this should not happen.
