I received the Mandatory Reconsideration decision today.

There is no change!!! So no surprises there then.

Can someone tell me how long do I have to apply for a tribuna lhearing, and can you tell me how soon should I expect a tribunal date after this.

I am going on a short holiday from 10th - 17th September at a friends home - and it freeby too! ( and I really need it) so is it possible to stipulate that I have a period when I would be unavailable to attend the Tribunal?

Hi BD,

I am sorry, but not surprised, that the MR did not go in your favour :( You now have 1 month in which to submit an appeal to the Tribunal Service. You will need a form SSCS1, the DWP don't seem to send them out these days but you can find one here -

It varies from area to area but you should expect to wait around 3 months for the tribunal. You can give dates that you will not be available when you submit the SSCS1.

I have applied to go to a Tribunal hearing following refusal to change my award from standard living and no mobility at Mandatory Reconsideration stage. I have the local Cit. Advice representing me. Yesterday I received the following text from the DWP.

" We have now got all the info we need to decide your PIP claim. We will send a decision letter once we have made our decision. Please call us if any details you gave have changed". TY DWP


I am most concerned about this text as it does not make sense, and cannot get through to my CAB representative today .

In bed with a fibromyalgia attack,feeling defeated, buy got Doctors appointment later today. Feeling wretched and utterly exhausted again, its been seven months of sheer anxiety and hell, since my papers arrived to claim PIP.

What do you think this text signifies, if anything.................

If you have completed the MR stage of the process, then there is no reason for the DWP to re-visit the Decision and the text makes no sense at all.

I'm afraid the only way to know what is going on is for you to contact them.

From what I've been reading elsewhere, the DWP are on occasion, making out of court offers to those requesting Tribunal appeals. Has anyone here had this happen or would any of the forum admin know of such cases?

Hi BD,

DWP do sometimes look at the claim again before it gets to the appeal.

In my own case, I has an ESA reassessment earlier this year which put me in the WRAG for 3 months. I appealed this decision (having gone through MR first).

After another reassessment I was put back into the Support Group. Not long afterwards I got a letter from DWP saying that they had looked at the first decision again and changed it to Support Group.

This isn't a common occurrence but it certainly does happen.
