Hi ive recently joined, I have been reading guides, is there anywhere in the guides that explain the questions u get asked at a medical assessment what they mean, for instance do u have a mobile phone, id like to know what the reason is for thst question for example, is is it explained anywhere?

Hi mrs hurtyback thanks for replying, ive read the guides, im confused about one point if u get found fit for work after a medical and ask for a mandatory reconsideration, when do u submit a sick note from your doctor? Do u send it in with the mandatory reconsideration or do u send it in if u have failed it and now wish to appeal to tribunal, is that when u send the sick notes in?

Also it says in guides that once the dwp receive notice from the tribunal that they have accepted your appeal then u can ask to be put onto assessment rate, my question is how do u know when the dwp have received the notice from the tribunal that u are appealing? Do the dwp send u a letter or do u have to keep telephoning up to see if they have received it?

one other question is if u send in sick notes from the fit for work decision and haven't claimed jsa do they backdate the assessment rate to when u was found fit for work? Any help be appreciated

It will depend on whether you claim JSA or not, if you don't then you can send in a Fit Note from the day after you are found Fit for Work, but it will not have any affect until the DWP receive notice that you have appealed at which time you will be eligible to the ESA Assessment rate backdated to the FfW Decision.

If you do claim JSA then presenting a Fit Note in advance of your claim being accepted can cause problems, you can submit one once you are on JSA and then should be excused your Claimant Commitment for up to 13 weeks.

Hi again, I have a question about the assessment rate while waiting for tribunal, im a bit confused I saw gordan state on a post that u can receive the assessment rate if its your 1st fit for work decision, but what its your second fit for work decision?

reason I ask is, i had to have a face to face in 2012 for esa, I was awarded 0 points, found fit for work, i appealed it, went onto assessment rate, went to tribunal was awarded 24 points, awarded wrag group, I have now gone for another face to face, didn't go well, so if im found fit for work again, which im expecting too, am I not allowed to claim assesement rate at all? Even when ive had mr and tribunal have accepted my appeal? Im confused? Oh and I had my medical recorded on a tape machine! Have no tape recorder! So can't listen to it.

Oh and how long are esa decisions taking at moment? And if a decision maker calls u to tell u u have been found fit for work is that normally quite quick after the medical?

oh one last question when can I ask for a copy of assessment report? Should I wait until I get a decision? Or ask for it straight away? Any help be nice, thanks...

You should be unaffected as the Fit for Work Decision was overturned at appeal. However, you cannot claim the Assessment rate during any Mandatory Reconsideration, the only benefit you can receive during this period is JSA. If you go onto appeal, then you can request the DWP pay you the ESA Assessment rate.

ESA Decision are taking about 2-4 weeks.

Yes you can ask for a copy of the report, just contact the DWP office dealing with your claim, the address or phone number will be on any of the recent correspondence about your claim and ask for the assessment report or ESA85.
