I think it is because your son has turned 20, under this age they would have still qualified for Child Benefit while still in further education and the CB would mean that they would be treated as a Young Person and not a non-dependant, allowing payment of the SDP.

I just got a call from DWP and they have backdated the severe disabled payment of £61.85 for per week for 17 weeks. Have they made a mistake. I also have a 10 year old living with me. I don't want to get money to which i am not entitled to.

As is usual with DWP documents the information is far from clear, but I cannot find anything that covers the situation for a 20 year old, all of the references apply to a child who is under the age of 20 (e.g. 19 and below).

It's not impossible that I am wrong but if I am not then the SDP is being paid in error and there is a risk that it could be recoverable if you have not notified the DWP of your son's age.

If you can easily get face to face advice from a trained advisor then you should. the relevant information is in the Decision Makers Guide. Chapter 43 paragraphs 43008 onwards.

thank you Gordon. I will call them in the morning about this. But could it be that i am a single parent with disability, reason being paid the severe disabled rate included in my esa. and a 10 year old in my care.

I'm afraid none of the these are the criteria for receiving SDP.
