Wife as WCA tomorrow. previous ESA 85 gave nil points but overturned at Appeal to Support Group.
2.5 of WCA Handbook requires HCP to refer to previous ESA 85 which was a load of rubbish. We have supplied copy of Appeal decision so will HCP take any notice of last ESA 85?
A copy of the Appeal Decision was included with current ESA50

We made a formal complaint to NMC about the previous HCP should we tell tomorrows HCP this if they mention previous ESA85?

Although we are not "holding our breath" the Wife's WCA carried out today by A Doctor and it seemed to go quite well.

Hardly mentioned the Mobility Activity but concentrated on another Activity that would if max points awarded give LCWRA.

We mentioned that we expected the Mobility activity would be discussed but Doctor said he could see that wife had obvious mobility problems that would probably give max points for Activity 1. as per previous Appeal Decision

All recorded on Cassette so hopefully wont need to a cCassette Recorder to produce a transcript for MR?appeal.

I took a copy of ESA50 with us which was useful because Page 5 of WCA50 was not with her file. This page lists all medical problems/history although he did say the extra info we had provided would have been useful if no page 5 was available.

I had something similar a few years back. I was in wrag after transfer from Incap Ben. However, After about 18 months on it my gp referred me for an nhs wheelchair as although I could walk a few metres my mobility was getting worse and worse. Upon receiving the device it was soon obvious I couldn't use it due to back and hand issues as well as my weight. My gp wrote a supporting letter confirming this and after writing to inform dwp I had been forced to start using a mobility scooter despite actually possesing a wheelchair. I was passed over to atos and they agreed to place me in support group on paperwork medical alone. I thus won my supersession. So as long as you give medical evidence, preferably backed up by your gp there is no reason your claim shouldn't continue to be viewed favourably.

I absolutely don't believe page 5 was missing by coincidence
