MR decision unchanged, so going to Appeal

I challenged my PIP decision, and the MR has come back unchanged, but has cited totally different, and irrelevant, reasons for approving the original decision.

Taking it to appeal now, as everything the Nurse said in her report has been rubbished by my GP, but still the DWP chose to ignore my GP and rely on what the nurse's opinion is.

4 months waiting for the MR decision, and now goodness knows how long for the appeal.

The PIP Appeal guide has links to the form you will need to complete in order to request an appeal and instructions on how to complete the for, although we have no up to date statistics, my impression is that most appeal are being heard in about 3 months.

thanks Gordon.

Previously a Tribunal decided that due to severe psychological distress I could not leave the house unaccompanied. The Tribunal preferred my GP and Carer's evidence, over the ATOS's nurse's report and I was awarded accordingly.

As the DWP have decided that I can go out unaccompanied, and that I can plan and follow a route of any journey unaided (again based on what a Capita Nurse said this time), will the previous Tribunal decision be relevant evidence when submitting my appeal?

My carer and GP both provided supplemental evidence to the DWP at MR stage, but the DWP preferred the Capita Nurse (no qualifications listed, just Disability Assessor Nurse) who claims I can plan and follow a journey unaided at all times.

I am slowly constructing this before sending off, so any help is greatly appreciated.

You can certainly submit information from the previous appeal (do they go into that level of detail?), but you need to show that your condition(s) remain the same or worse for it to carry weight.

yes, the Tribunal does go into that much detail, and my condition is the same as it was when the Tribunal decision was made.

Thanks Gordon, I will definitely include the transcript with my Appeal paperwork.

Appeal submitted, with a copy of the extensive Tribunal report from the last DLA tribunal.

Just have to wait and see what happens now I suppose.
