I won my appeal for pip and given a 5 year award. However when the letter came from Dwp it ends in December ( an 18 month award). I phoned DWP to be advised that as I live in France they looked at my insurance contributions and they have run out an d my husbands cover me till December. We have lived in France for 18 months and both worked our whole lives and paid NI.

I cannot see anywhere where NI is a factor in PIP awards. I thought these awards were not means tested. I was claiming DLA before leaving UK and migration to PIP application before leaving. I have never heard of this.

I was advised to claim ESA by the DWP adviser, but not sure this is correct as I have an occupational pension. I live in France and therefore how do I get a fit note?

I am still a taxpayer in UK on my pension but this does not include NI. If I pay voluntary NI would this help ( she says clutching at straws). I am so upset as I fought for 18 months for PIP award and then this.

Can you point me in the direction of info on the NI question as I did not understand the DWPs explanation of why my payments will end 3 and a half years early.

They are breathtaking!

Hi Leofwen,

This doesn't seem to be a straightforward issue. The gov. site says that claiming PIP whilst living abroad will depend on NI contributions but does not clarify the issue.

Despite the Gov UK site I can find no reference to a requirement for NI Contributions for PIP in any of the associated legislation.

It's possible that there are issues with your meeting the past residence test but again I cannot see anything that would limit the length of an award.

I suggest you contact the DWP and ask for an escalation of the issue to a manager, this will require a call back. If you get the same answer then ask for details of the legislation and in particular the Regulations that they believe apply.
