Questions again I'm afraid.

As mentioned yesterday, the DWP suggested we make a formal complaint to Capita. We are already in the process of compiling this and propose going through the various descriptors one by one along with outlining the inconsistencies and contradictions within the assessment.

I have already told DWP I a wish to requesting a MR, as the issues are one and the same as those being raised with Capita s it is that resport that has created the current position can the same document form the basis of the MR request ?

Also on timing of the submission for a MR, they made a point of telling me (even put me on hold whilst they double checked) that this has to be submitted within 21 days and not 28 days as previously.

Did I read correctly on another thread that you suggest requesting forms for an appeal at the same time ?

Whilst it is possible that DWP guidance on this matter has changed, I'm not aware of this happening, that doesn't mean that it hasn't, but they should offer four weeks from the date of the MR request letter or the date of a phone call making the request.

That said, we do regularly hear from members who have made full use of the four weeks only to find that their evidence has not reached to the DM by the required time and has not been consider, so we would always advise that the information is sent as quickly as possible.

You can download and pint the forms for an appeal yourself.

Actually it's the Tribunal Service, the MR & Appeal guide has links.

Many thanks again for the info.

I have today submitted an eleven page formal complaint to Capita, copied to DWP along with my confirmation I request an MR.

Hello again,

I wonder if you can clarify issues relating to housing benefit.

As Gordon predicted the Council had early notification of the PIP reductions to what I previously received in DLA and Mobility and our landlord received written notification that housing benefit has been reduced.

I was always under the impression that DLA and Mobility were not taking into account as income and only state pension and pension credits were when making housing benefit awards. Our housing benefits had always covered the full rent payment.

Has the introduction of PIP changed how this works ?

What I am struggling with is that having reduced my lifetime higher rate DLA and Mobility with the PIP changeover and my income reduced by several hundred pounds a month, my housing benefit has also been reduced leaving me to meet the deficit from a reduced income.

Not to mention the loss of my mobility car, a nightmare when we live in a very rural location two miles from the nearest habitation. My head is in turmoil as to how we are going to deal with this - I have spoken to Motability and they advise they will try and help customers, but whatever may or may not be possible, the actual financial outlay is daunting from such a huge reduction in benefits.

Also you may be interested to know that after verbally requesting a MR, the DWP called on Friday, hubby spoke with then and it seemed they were really trying to persuade us otherwise. Having read your advise on this and that sometimes they claim not to have received claimants further written submissions he confirmed to them that they already had a copy of our formal complaint to Capita and we would be following this up with further written information. I am aiming to get this in tomorrows post and just hope they haven't rushed ahead without sight of it.
