Hello again

We've been reading over the medical report again and in the review section is says 2 years. But reason for this is that:-

"the review period takes in to consideration the long term nature of her health condition. It is anticipated that her level of functioning will decrease"

I don't understand why the award suggested time is only for 2 years.

Hi

I have just measured the distance from the house to our car and it is 5m not 15m as stated on the medical report. The assessor was using this distance to say my wife could be expected to walk 2om but no more than 50 as the car was 15m from the house!

We would like to correct this error now rather than wait for the official decision letter. Is this possible? Also who would we send the letter to?

This is so important as the decision not to award the enhanced rate of mobility seems to rest on my wife being able to get to the car outside our house.

Any advice would be appreciated.

There's no harm in you writing to the Decision Maker about the distances, but in isolation I think it is unlikely to influence them, but with the PIP2 may ne more credible.

Award lengths are primarily determined by the likelihood of change, this could be the claimant getting worse as well as better. Several members have tried contesting the period, all have failed, although they have not taken it beyond an MR.

Sorry about all the posts but we are so stressed. My wife called DWP and spoke to a very nice woman who said she hadn't heard of this situation before where there was an error on the medical report that needed changing before the decision had been made.

My wife made it quite clear that this was not a Mandatory reconsideration .

The woman put a note on the file for the decision maker to see . She put that the distance was 5m not 15m to the car and that my wife could not do this repeatedly or reliably. The assessor states in her report that it could take my wife 2 days to recover from doing this distance (the 15m) The woman said that someone, presumably the decision maker, was looking at my claim now.

My wife asked for an address to send a written copy of this amendment and was given the address

Anyway we are hoping this will make a difference to the outcome and we can still keep the motability car.

We haven't sent the letter off yet. We intend to do it later today. If there is anything else you think we should put in the letter please let me know.

My wife asked for a copy of the notes that had been put on her file regarding the 5m, the woman said, after she checked with her manager, that she would send a written copy to her.

So we will just have to wait and see. At least they have given my wife 14 points regarding care. The medical report, apart from the moving around points, was actually quite accurate. There were a few minor errors but we are not going to challenge them. I know that if we ask for a mandatory reconsideration when we have the decision and it is still only 10 points for mobility then they could look at the whole award and she could technically loose points.

Hi Peter,

We have never seen an amendment before a decision is made, so don't know how this will be viewed. There is a first time for everything!

Yes, an MR could reduce an award - but you would still be able to appeal this.

Incidentally, you don't need to post another message if yours does not appear straight away. Even when the forum is officially 'open' there will still be a delay, depending on who is on duty and how busy they are. I know that Gordon has delat with a lot of messages on his own this afternoon.
