Called for DLA to PIP Assessment at private physio

Im sorry they dont consider going to and from the toilet thats what they wrote on my decision letter and they dont consider kerbs anymore They used to with DLA but PIP do not consider that and if you go around the house with a walking stick they look on it as if you can walk. Sorry for the bad news.

Walking in house is only short walks - husband been measuring distances. All less than 10 metres. I didn't tie the walking to other issues, I think decision maker relied too much on the Atos assessor who has constantly lied - I'm assuming the same carp assessor is the one who wrote the latest lies about me to DWP.

I agree the DMs comments suggest stuff, its not stuff I ever suggested. It's yet more lies.

Denise, look at my earlier thing about what the Judge said about outdoors and kerbs.

I don't live in a mansion anyway, so any mobilising I do round house is less than 10 metres at a time. The toilet stuff is irrelevant I think, I don't know why they keep harping on about it, don't even recall mentioning it much but they go on and on about it. To be honest I wonder if they even got my MR or if they just stuck a random different one in my file. Sigh.

Got copy of my GP's letter from DWP - arrived on Sat morning, but I had a fall last Tuesday and have been bed ridden and hardly able to use computer since (fell on my bum and then further backward and hit head) as back is so painful and can't sit for long.

Anyway, seems to me the part the decision maker is quoting is this:

"She needs help to get up from a chair/bed. There are some days (1-2/7) when she is unable to get out of bed."

But this is included in a list of a load of other stuff about how limited I am:

Her mobility is limited to short walks within her house but she needs the aid of a walking stick. She needs help to wash, dress & mobilise which her husband does. Her husband cooks & cleans & has to prompt her to eat & take medication. She bathes once or twice a week & is only able to brush her teeth once a day. She needs help to get up from a chair/bed. There are some days (1-2/7) when she is unable to get out of bed. She seldom goes out but if she has to she has to use a wheelchair to move. There is little prospect, at this stage, of any improvement.

Mrs X's condition is made worse by spinal degenerative change causing daily pain & difficulty mobilising.


She then goes on to talk about weight loss, abdo pain and being referred for fast track to exclude cancer (fortunately all clear - but I do have diverticular disease).

Then under Symptoms and variability there's more stuff but can't sit for long enuff to copy them right now, but much same as above quotes.

Have to get my Tribunal form off soon but hard to sit to write and can't write lying down!

Urk!

Just had a thought since my last post - sorry! :blush:

Want to get any evidence ATOS has on me - eg the complaint I made and their response, plus their reply to my MP and anything else they have. This is to help my case for Tribunal.

Can I do a Subject Access Request to them for that? I have an address that came in letter in reply to my complaint, so would send to that I guess.
