No, you cannot request an MR until a Decision has been made and you never know the DM may not agree with the assessor.

The assessors comments seem weak but there is nothing unusual in that as to whether you have been treated harshly, it's impossible for us to say with no view of your PIP2 or a proper understanding of your problems.

Is it rare for the DM to award more points than the assessor recommends? Do the mark you down even more in some cases?

DM's tend to follow the assessors recommendation but they do on occasion use their own brains and mark based on all of the evidence, Where we have seen it happen they have probably marked up more than down.

I've had my decision and as expected its the same as the HP's score, 8 points daily living and 4 points mobility. I'm not sure what to do from here the award id being looked at in one year. Can I ask when the award gets looked at again is it the same process all over again as if from scratch? If it is I might just accept this decision learn from it and just hope I can make a stronger case next time.
Final question will my award qualify me and my family exempt from the benefit cap? On the DWP website where it lists the benefits that make people exempt from the cap it just says PIP no mention of what component of PIP does this mean any PIP payment exempts you from the cap?

I would like to than Gordon and Mrs HB for all their help and would like to say this site has been of great help to me and no doubt I'll be back on here in the future when re claiming my ESA and PIP x

Hi Onestep,

I'm very glad that you finally have a decision on your PIP - but sorry that it was not more favourable.

There are now 2 avenues for reassessment -

Some claimants recieve another PIP2 to complete in detail

Others get a shorter form asking whether things are the same/better/worse.

We have not yet worked out the rationale behind deciding who gets which form :(

I know this leaves you in a quandary - to take things further now or hope you get the full form next year and can make a better job of explaining your difficulties.

You do not have to decide now, so I suggest you give yourself a day or so for your thoughts to settle. Then think about your realistic chances of scoring more points - especially if hoping to gain a mobility award for mental health issues.
