esa appeal was created by mrmetallica
ive just had my appeal for ESA after getting zero points .
i had a pip medical recently and received 10 points for mobility but zero for ESA .plus other points for other things .
was told they will let me know the decision in the post .
why do they sit belittling you asking about your mobility as if it cut and dry that you cant walk a certain distance the same every time when the question is cant walk more than 50 mtrs without severe pain and where did you get your stick did you buy it .i was even asked on one medical who taught me to use it ?

after the high court is there anything to do if i get turned down ?

Hi and Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Welcome to Benefits and Work

I'm sorry that you are going through this :(

Don't forget that the ESA mobility descriptor is very different from PIP in that the ESA assessor is allowed to consider the 'imaginary wheelchair'. This means that s/he can decide that you would be able to self-propell a manual wheelchair and thus score zero points for mobility - even if you have never used a wheelchair and never been advised to do so. It might be that you have fallen foul of this.

Our ESA guides describe the descriptors against which you are being assessed and also the appeal procedure.

ESA claims and appeals

There are other appeal resources in the members' area too.

If the tribunal finds against you, then I'm afraid that is probably the end of the road for this claim.

May I suggest that you bookmark/favourite this on your web browser now so that you can find it easily in future? This will allow you to return with further questions or comments about your ESA without having to start a new topic each time. It helps us enormously when everything relating to the same claim is kept in one topic - and I hope you will find it useful too :)

Nothing on this board constitutes legal advice - always consult a professional about specific problems
