TOPIC: Contribution ESa claim and conditions

Contribution ESa claim and conditions 1 month 3 weeks ago #170905

Hi I need to check re the conditions for NI to satisfy the first and second conditions.

If I applied January 2017
Benefit years would be
: April 2015-2016
: April 2014-2015

April 2014-2015
I was in support group for ESA

April 2015-2016
I was working full time earning above the LEL for 50 weeks of the year (started work 13.4.16)

Would I be able to claim?

Thanks for your help with this

I don't see why not, you appear to meet the current Contribution Conditions.

Thanks Gordon,

I am worrying as when I left ESA for work I was told by the 'helpful' Benefits Helpline or Job Centre that 'you'll have to basically work for a full two year to re-claim' and I haven't done that.

I'm still working at the moment but it's a real struggle and I keep becoming very unwell and in hospital and I'm not sure how much longer I can 'hang on'.

So - my ESA contributions in support group count towards the conditions then?

Thanks
Ruby

Don't assume that the call centre staff know what they are talking about :(

The First Condition requires the claimant to have a minimum of 26 weeks or NI Contributions in one of the two proceeding Tax Years. You say you have worked in 2015-2016

The Second Condition requires the claimant to have a minimum of 50 weeks of NI Contributions OR Credits in both of the two proceeding Tax years. You worked and received ESA in both of the required Tax Years,
