Hi,

I'm going through an ATOS assessment report. If there is 'FME' against an item does that mean that they have the evidence or that it should be sought and if so by whom ATOS or DWP?

It means they have it. If they need more evidence then they would have sought it before sending the report to the DWP.

Hi,

I have now read the ATOS medical report. There are many instances of 'inaccurate recording' to put it politely. One example is 'no breathlessness reported or observed before, during or after the assessment'. My daughter had reported my breathlessness on arrival and I had a panic attack halfway through the assessment as I could not breathe, the assessor asked if I wanted to halt the assessment and continue at a further date.

Is it worth the hassle of making a complaint?

There are two answers to this :)

As an outsider (to the process) it's easy to comment that if nobody complains then things can never get any better.

On the other hand, this is not about us, it's about you! Do you feel capable of making a complaint? It could be stressful, especially if the issues are things that effect your claim, the Assessment Providers don't have a good reputation for putting things right, however, on occasion they do and we have even seen assessors fired (and rightly so), for falsifying reports. So if you feel up to it and the matter is important to you then I would encourage you to complain, but you shouldn't feel guilty if you don't.

The following is a summary of the 3 page letter in response to my Atos complaint that basically just told me to appeal the DWP decision.

‘Atos Healthcare’s Client Relations Team have reviewed the points you have raised and are unable to reconcile what was said or not said at an assessment as we were not present.’
‘Within your correspondence you highlighted that you feel the HP has omitted or misrepresented the facts.’
‘However, if you are unable to provide supporting medical evidence to support your claims we will not be able to pursue the matter any further.’
‘Consequently, the presumption cannot be made that, when a Tribunal overturns a decision, it was due to a lack in the validity or accuracy of the examination report used in the decision making process.’

If Atos don't take responsibility for the HP who does?
