on behalf of my brother in law please can you help us he was awarded pip dla enhanced and mobility enhanced two years later at the assessment (jan 2016 ) he lost both he put in a appeal but he was informed there is a long back log,and so in the meantime to reapply for new pip as he had more heath issues at the new assessment (may 2016) he was awarded new pip of dla enhanced and only standard rate mobility, for 3 years he has since asked for a manatory reconsideration and has not heard anything even after many phone calls,
in the meantime his appeal was heard this week on the old pip and he won and got awarded dla enhanced and mobility enhanced for 5 years backdated to when it was stopped so what will happen now ? as he would like the appeal decision to take the place of the current new claim

I'm afraid, as the new claim resulted in a new Decision that was later than the Decision that he appealed, an appeal re-makes the original Decision it does not create a new one, it will that Decision that is taken forward. So the Appeal Decision will apply from when his PIP stopped to the date that the new claim started.

He can use the Tribunal result as evidence to support the MR and if necessary any new appeal that he makes.
