Well i guess it is about time !

OH has been on ESA (SG) CB since 2009. He was put directly into the support group , following a 5 minute home visit.

Seems the cardiologist letter to the DWP gave "compelling evidence" . He had been told , "go home and do what makes you happy..we can do no more"

in a nutsohell, 3 cva strokes age 30 , left with Central Post Stroke Pain Syndrome...10++, both right and left hit after 3 strokes.

Confirmed thrombotic blood disease , blood clots in legs, lungs, heart and brain , now "life limiting" heart disease , right artery is 98% metal , too high risk for by pass. 3 lots of surgery since 2009.

Pulmonary clots now has COPD and currently under London hospital investing enlarged nyphode on lung..and recent Cardiac MRI confirmed a recent heart attack...

he is death warmed up , in pain all day ..and night , breathless, chronic fatique , now sleeps for england , up a couple of hours ..and his day is over...all very depressing..on a shed load of drugs..brain drugs that can make him seem gaga some days...22 years...he is nearly had enough ...the impact has taken its toll on my own health ...big time..as it often does with carers.

so if he were found fit for work..he would be a dead man walking....his health has deteriorated immensely since 2009..not sure how that is possible ..but it has..and he is still with us ..

please can you point me in the right direction by way approach this esa50..i have umpteen medical evidence letters and both the cardiologist and GP will support him I know.

am i right that there is a way/ regulation / ruling? to be put straight into the support group when someone is gravely ill ?? like it did in 2009?

thank you in advance RD :(

Start with the ESA Claim guides.

www.benefitsandwork.co.uk/help-for-claimants/esa1

He might qualify for the SG based on the Exceptional Circumstances Regs. have a look at the Should you be in the support group because of substantial risk? section.

Hi Gordon

would it be helpful if a support letter from GP quoting/explaining why reg 29 and 35 apply....and a home visit ... at this stage ?

or prehaps go easy ? this is going straight in the deep end ?

There's absolutely no value in holding back information, it's about getting the right award as quickly as possible. If your GP is willing to provide a letter on these points then you should take them up on it and include it with the form.

well well...and so it goes on...

went to GP this morning, he is more than happy to write a letter of support in exceptional circumstances....i left details of what i will be putting on the form and info about regs 29 and 35 ..he said , no way is he being assessed. ..he is made a 2 week referrral re lung ..to rule out cancer...so we get back home and low and behold ...an ESA50 has now arrived for me!!! again!!

whilst i know the process is ongoing this will be my 4th medical with atos in less than 2 years! so 2014 - claim PIP . 2015 medical 1 , no PIP , request MR= no, appeal allowed july 2015.at tribunal. 2016 reassessment , medical 2 , score 9pts , now on more PIP than appeal allowed !

July 2013 claim ESA, refused at assessment phase , MR allowed , medical 3 May 2014., awarded ESA put into SG.. so now assessment again.

all i can think , is this, as the recent change in entitlement to PIP , triggered the SDP for ESA income related ....and underlying CA....we are on the hot list...for re assessment ??? so much for the government calling for a stop on continued reassessment.

we both want our old lives back now ..please....

Talk about kicking someone when they are down!

I am so sorry you are now having to go through another ESA assessment. I don't think your MP could do anything to help you personally but, when you have the time and energy, I do think s/he should be made aware of how people are really being treated.

Contacting your MP

The talk of people with some conditions not needing repeated assessments is just that at the moment - talk. It has not been agreed yet and we have no idea of what conditions might be included if/when it does ever go ahead.

I guess I don't need to tell you how to find the ESA guide, do I? :(
