Atos nurse lies and assumptions was created by Shep66
Hello my medical report was based entirely on assumptions and lies, she has given the decision maker the impression that my condition only affects me 2 days a week, and apparently I said so !!! Here are a few examples, the hp she to me on the day and I quote I won't ask you to do any neck movements as you said it is painful for you, she is referring to what I've put in my claim pack as I never mentioned anything on the day because I wasn't asked . In her report she put down claimant declined neck examination. I went to the toilet three times during the assessment and on the third occasion completely wetting myself clothes et cetera of course as she was waiting in the room next to me I was unable to change so went back into the room explained what had happened she said oh we nearly finished anyway, The only reference she made to this was claimant went to the toilet twice, unbelievable. I read your guides and sent a letter asking for a mandatory reconsideration, I wrote on the letter that I hadn't received the report yet but when I did I would respond and send another letter. Unfortunately my response to the medical report was too late and the mandatory can reconsideration had already been done. What to do next I am absolutely so upset over the whole thing.

Shep

You can try and push for a new MR on the basis that you were not given time to provide additional information but you should give some thought as to the likelihood that this will result in the Decision being revised as it is unlikely that it will.

Alternatively you can now go onto to appeal, have a look at the PIP MR and Appeal guide it has links to the SSCS1 form that you will need to complete and instructions on how to do so.

Thank Gordon, yes I have been reading about the appeals process, the time scale was as follows, The decision letter was dated 3 September, I received this on 8 September, I read your guides and wrote requesting a mandatory reconsideration. I also said when I received the medical report I would write back to them and would provide a letter from my hospital neurologist and well as my response. Unfortunately they made the mandatory reconsideration on 12 October and my letter crossed with this. I have made an appointment at the C a B but they can't see me until next Monday. I will let you know of my progress, thank you so much for your response.
