Need advice on two things
Firstly I informed DLA Feb 2015 informing them my disibility had got worse n needed more help as I'm was on lower DLA LIVING and my award shld of be reviewed as they shld of moved into middle or higher rate of my change heard nothing back so I wrote to them again April 2016 as my disibility had got worse which I told them in Feb 15 I shld been in the middle rate or higher rate not lower rate so they said they got my change in circumstances letter and if I want to apply for pip so I did sent all forms.bck in July 6th and got my award letter august 2016 saying I had been award standard living rate and high mobility rate and will continue getting DLA living rate which they didnt give me the correct award it's was lower rate when by law I had informed them twice my change of circumstances still nothing got DLA until sept 24 and my pip will start 25 sept I do believe that either I shld of been awarded the correct DLA as they contiued to pay that until sept or they shld back pay me pip to when I applied which was June

Also got a letter saying I might be entitled to SDP which is an extra 67.00 to help me as I'm on esa support group and now they hve said I'm not entitled to it cos my daughter is 18 years old I understand if I lived with someone but I don't it myself my daughter n my 12 year old son and I don't see y it's shld affect me just cos my daughter lives here and is 18 it's nothing to do with her why I Carnt get SDP it only states an adult living with me not my children being 18

I am afraid there is no backdating of a PIP award if the claimant was receiving DLA, the legislation specifically prohibits this. The Government's excuse is that the intention of PIP is to reduce the disability budget and many claimants will see a reduction in award or no award at all which would have created a recoverable over payment, of course the legislation could have been worded to take account of this.

I'm afraid unless your daughter is still in education then there is no wiggle room in regard to your living alone for SDP. As an 18 year old she is treated as a non-dependant.
