Turned down for ESA after WCA.

Hi all,

I have a friend had WCA refused ESA, asking for MR. They have told her to claim UC.

They do not satisfy the gateway conditions for UC in this area, also they are in receipt of, PIP, Industrial injuries benefit, and are appealing WCA decision.

I think they should claim Job Seeker Allowance, should keep their fit notes up to date whilst reconsideration and appeal is progressing. Is this the right way to proceed.

Providing they are not in a Digital Full Service area for UC, then they should be able to claim JSA if they ask for an MR of the ESA Decision.

They should ask there GP for a new Fit Note, once there JSA claim has been accepted (and not before) they can present the Fit Note and be excused from any Job Search requirement for up to 13 weeks.

Hi Gordon thanks for that, one question. My friend has already fit note in covering them up until
The 13/11/2016 ( cover pre refusal to grant ESA)This one is to be renewed before that date for another three months.

My question is should they renew this after the sign on for JSA.

A new certificate will be advisable to give to the JobCentre when your friend's JSA claim has been accepted.
