Thank you Gordon. I dont think I can cope with attending so I'll most likely do paper.

I have another question.

Does anybody know if it would be acceptable for me to use the same mandatory reconsideration letter for my appeal also? It is in response to the DWP/decision maker but it lists all the points I believe I should have scored on and lots of detail. Its a very long letter 15 pages long. I also stated things wrong that were in the ESA85.

Would the tribunal read this if I sent it to them with everything else or discard it, unless I copy and paste it on a new sheet of paper addressed to the appeal.

Your MR letter should be included in the DWP submission as one of the documents used in the making of the Decision, you will receive a copy of this from the DWP once your appeal has been accepted.

When you receive this, go through the DWP submission to make sure that there are no issues that you need to address.

I'm a bit confused. Do I send in my appeal submission with my SSC1? Or just the SSC1 at first?
Or am I supposed to wait for DWP's response to my appeal and send it after with the rest of my further evidence?

Hi Rachel,

We suggest sending in your SSCS1 form on its own initially and waiting until you have been the DWP reply before you write your submission.

Hello, I have sent off my appeal pack, I guess I am awaiting DWP response. I can not cope with face to face so I chose on the papers. Last mental health appointment I had, I cried about 5 times and I was a mess, it was humiliating and I cant do this again. obviously i cant cope with this and I'm just hoping for the best, it's out of my control now. My GP was not very helpful, she didn't return the form 113 even after my parents tried to chase it up. But on the other hand she is my new GP and I've only seen her once.

I want to ask, how do I receive the assessment phase rate of esa again?

I asked at the bottom of the ssc1 form and am second guessing if I did it right. Will they sort this for me or, DWP will read it when they get sent it and automatically do it for me? Or is this another thing that needs to be chased up. Am I not entitled since being rejected? (am not on JSA, can not cope with the humilating appointments, at least I am living with parents). This is my second claim but first time experiencing this 0 points rejection as first one years ago was successful.

Once you have received a written response from the Tribunal Service accepting your appeal you need to contact the DWP and ask to be placed on the Assessment rate while you wait for a hearing.

You will need to provide the DWP with a Fit Note starting from the day after your ESA was stopped and maintain one until the hearing.
