Hi all.
I just wanted to add that I complained to dwp, capita and wrote to my MP.
No response from MP despite 2 letters and a phone call.
Capita has responded nearly a month later to say they 'are unable to uphold my complaint'
And dwp have declined my application stating ' I didn't give them a good enough reason for not attending my appointment '
I'm sort of at a loss as to know now what to do.
This might be a little but futile but does anyone know if I can bring legal action against capita ?
This whole sorry mess has resulted in me being admitted to hospital and requiring to take another 2 medicines for uncontrollable BP. I've been suffering with grade 3 hypertension ever since the morning she failed to do my assessment.
I Just can't seem to get my point across to anyone, I don't understand how this can be allowed to happen. In any other aspect of life if I had a genuine complaint then what I say would not be discounted . The worst part of it is that it's all faceless , the phone calls are costing me over £3 a time, money we can't afford. And trying to keep a positive attitude for my kids this near to Christmas Is the hardest of all.
Please any advice would be greatly appreciated !

Even if you could take legal action against Capita which I very much doubt, it would not help with your benefit claim as it would be completely separate from it.
Your next action is to request and appeal with the Tribunal Service. Have a look at PIP Appeal guide, it has links to the SSCS1 form that you need to complete and instructions on how to do so.

Thanks Gordon for your reply. I understand that taking action against them is improbable and wouldn't help my claim. It just is so frustrating that capita can get away with treating people like this. Surely ultimately their assessor who has to hold a full registration with NMC, HCPC, GMC should have a duty of care to their 'customers', and not adversely effect their health through their actions or lack of. Thanks anyway I will follow your advice .
