ESA AWARDED AFTER CONTACTING MP - DELAYS

In August 2016, we received the letter for the Re-application of the ESA, my husband was in the Support group for the last 8 years, we provided Psychiatric reports and medical reports as he suffers from Schizoaffective disorder which he has now been advised there is no chance of a cure, he was retired from work in 2011.

Nearly 14 weeks later we still did not have a response, I am his appointee so called last week and was advised they need to sort a house visit out, despite a Gp and Consultant letter advising this would be a bad idea, on Friday last week I sent all the file to my Local MP, they contacted me on Monday and advised a decision was made last Friday (what a coincidence) and he has been put in support group - which I am happy about as all the medical evidence supported this.

We have now just today received that Notice by letter confirming this, my main concern now is the PIP from DLA, can I use the fact that he is in the Support group when this benefit comes up for review and will I have to go through all the forms and applications again, especially considering that my husband has been on Higher rate for care and Mid rate for mobility since 2009 for a indefinite period, he is also on a industrial injuries benefit of 60% for life due to the illness cause while he was at work and had a serious accident which caused his demise into mental health.

I would appreciate your help as always.

Hi Newb,

I'm very glad that the ESA was eventually awarded without a face2face assessment! Thanks so much for letting us know.

You can certainly use the ESA report when the time comes to claim PIP. However, the criteria for the 2 benefits are very different so you will have to explain how the ESA report is relevant to the PIP descriptors. I'm afraid there is no automatic qualification, you will have to complete the PIP forms in detail and submit all supporting documentation.

How would I obtain the report from the DWP as I am going to use that to my husbands best advantage when the PIP claim is due.

Just phone DWP and ask for a copy of the assessor's report. This would be an ESA85 if there was a face2face, in your case it will be an ESA85a.

So glad your husband got his award for support group and well done for getting your MP involved, although this should not have ever been necessary! :)
