Hello all,
Recently had PIP tribunal, appealing against being given standard rate on daily living and mobility.

Have spinal degeneration, Raynauds disease, rheumatoid and osteoarthritis and bladder problems. We found the Tribunal a little bit intimidating, and my husband, although appointed my representative, had very few opportunities to speak!!
Basically, any reference to the 150 page PIP Assessment Guide , amended 01 May 2016, as the Judge clearly stated is "Just a guide"!!!, so not really worth referring to at tribunal level.
So what do you refer to ??
You need to base your appeal on the law, in regard to PIP, and focus on that.
If you think that the evidence you have gained, and that like us you have a strong case, unless you can bring enough doubt on the legal aspect, I think your on a lost cause. When we asked the Judge " Is the onus on the DWP or ourselves to provide evidence ?" we just received a wry smile... Be in no don't it us up to the CLAIMANT. We also had a Professor, (Doctor) who should have had an interpreter
We kept the the award we have, but lost our appeal. No wonder the DWP do not attend these hearings, they all ready know the legal outcome.
If going for the higher rate of both functions, in my opinion, you need supervision by another person, 24 hours a day, and your conditions have got to be reinforced by medical personnel, in writing and a FULL detailed history, from the first day you went to your GP,Accident and Emergency Department or Walk in Centre, to the present day. I have had my conditions since the mid 1980's, so you can imagine the work this will involve.
