I'm afraid, by refusing to attend you have failed to participate in the process and the DWP have refused your PIP claim, a Decision on your PIP claim having been made, your DLA claim is automatically closed.

This is an appealable Decision, the first stage is for you to request a Mandatory Reconsideration, see the PIP Appeal guide and the PIP section for template letters you can use.

You will need to provide up to date medical evidence why you cannot attend at ATOS's offices.

You also need to be aware that all that this will do is to restart your PIP claim, it still cannot progress unless you have a face to face assessment or ATOS decide that one is not required, if the MR is successful then you should be able to use the evidence that you submit for it to try and persuade ATOS to offer a home assessment.

I felt so depressed to hear this. I begged them to change it to Redhill and they refused.

Could I ring the DWP and ask why my reasons were not satisfactory and ask for a reconsideration and if refused ask for a mandatory reconsideration and then appeal if that too fails?

I was worried I wouldn't be allow to ask at all because they turned me down dead without an assessment.

Should I just put in a new claim or am I now barred from that too?

I wish I hadn't been forced to apply for PIP by the DWP and just let my DLA run out in October.

The worst thing is my Carer has no money now what rate would I need to keep them? :sick:

You can ask for their reasons, but if you are going to ask for an MR (there's no such thing as a reconsideration any more), then the DWP need to receive your request within one month of the Decision closing your PIP claim, if that fails you can go on to appeal.

You can make a new claim for PIP immediately provided you are under the age of 65, otherwise you will need to claim Attendance Allowance, but you will need to be prepared to attend at the Assessment Providers offices, or you will simply have the same problems as your first claim.

Any PIP Daily Living or AA award will enable a claim of Carers Allowance.

:sick: Sorry not replied sooner not been well.

I rang DWP because my letter was dated on the bank holiday weekend they never sent a Good Reason letter just stopped my DLA 28 days from the day of the assessment.
I sent a Good Reason letter which they got on the bank holiday Friday so clearly the decision had been made long before they got it .

I rang them and told don't ask for M reconsideration but explanation and of course have not phoned back. I see on your site it says they are a waste of time.

I worry if I start new claim they will think why bother with the old one and leave it declined.

Either way I am sicker and poorer. It is all a catch 22

You need to think about making a new claim, if you go to appeal with the previous one then it will be at least a couple of months before your appeal is heard and if you are not successful then those months will be lost if you then make a new claim.

:S The DWP is livid because I have put in a new claim while asking for a MR.

I explained it was mainly because my Carer has no money and can only be back dated 3 months.

Worried I have done the wrong thing :sick:
