ESA Stopped After Medical - Reassessment. was created by Rachel
Firstly, thank you for this very helpful site.
Unfortunately, after being in the ESA Support Group for 1 year, I was reassessed as
being Fit For Work. This time I was assessed by a Nurse rather than a Physio and from
the beginning I realised it was not going well. I have received the phone call and
cannot believe the outcome. Obviously I will be contesting this.
My question is - I am signing onto Job Seekers, but am going to try to get signed off
sick once I have had my initial meeting with them. Should I ask the doctor to use the
main condition that I was on ESA for initially, or use another condition?
The person I spoke to on the phone re my points, actually said that I should claim
Job Seekers even though I might not be able to get a job! As we know if I cannot fulfill
their requirements, I will get sanctioned.
Thank you for any advice re the fit note.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

It shouldn't matter what condition the GP uses on the Fit Note, just as long as the certify you as Unfit for Work and don't apply any conditions.
Make sure your JSA claim is accepted before presenting the Fit Note.

I have just received my medical report form today.
So many things mentioned that were not talked about, including physical examinations that were not carried out.
One of the silliest things was the fact that I was supposed to be carrying a medium sized bag. I had a small carrier bag with a few folded pieces of paper in it.
All I can do is answer each comment correctly, but it does concern me that they can twist what we say and write down that we can do certain movements when we cannot.

Hi Rachel,
Don't forget to concentrate your time and energy on showing how and why you meet the descriptors, as that is what will qualify you for ESA, don't get bogged down arguing against every sentence that is wrong!

Yes, I understand what you are saying Mrs. Hurtyback. As I go through it again I see so many incorrect statements, but I do know what you mean.
She said that I could turn my neck etc. which wasn't even checked. It is my neck that partly causes balance problems. This is the sort of thing I should be concentrating on, I would imagine, not the 'silly' things. Sorry, it has just made me mad though as, like for so many others, it is a life changing decision they have made.
