Hi again, after receiving my phone earlier call last week from the decission maker and we said about my condition become worse I July, which were my hands and feet, which then in September having me to purchase a wheelchair for outside journeys.
I have now had a chance to have a think and recall that in my 2 previous claims I put in I said that I had trouble walking and very rare went out, my partner always did the shopping etc. But I did manage with crutches walk to my local shop when I needed cigarettes as my son could not do that when I needed Jim to go to shop after school for me.
In my last two claims the decission makers have said that I was able to walk the 50-200 meters. Which I could but very rare but had to stop due to breathing problems and agonising pain.
Would I be able to put a appeal in regarding back payment on mobility with the dates that i have been given this time which I am sure my Dr would do a covering letter. As the decission maker caught me off guard with the phone call as it didn't help having fibromyliga, and I didn't have a chance to tell her about mobility.

You can only challenge a Decision if it was made within the last 13 months, even if this is not the case then the first stage is to request a Mandatory Reconsideration, however, you will be outside the normal one month to make ta request for an MR, so your request will be classed as late and you will need to provide Good Reason for this.

The Decision whether to accept a late MR lies wholly with the DWP and cannot be appealed, I think that you will struggle to convince them to accept a late request as you appear to have no reason for not having challenged the Decision so at the time, however, you have nothing to lose by trying if you are still in time.

I have phoned pip today and waiting for call back. I have just read about someone with the same sort of problem and there was mention about regulation 35, where would I find this please.

Regulation 35 is for ESA not PIP.
