Pip appeal failure was created by Kelly
Hi I had a pip appeal last week to look at my care result as I was only 2 points short for standard rate. I feel like I was totally unprepared for the meeting. I had a member of welfare rights with me but it felt like an interrogation rather than exploring the section of care I was asking them to look at. My financial situation is now a nightmare as my esa was cut as well as a large drop from Dla payments I used to receive. I gave evidence from specialist as well as gp but this didn't seem to matter. I've been told by welfare rights this is all I can do unless circumstances change and that I need better medical evidence. I feel so stressed out and worried I don't know if I have any options left. Any help or advice would be much appreciated. Thanks xx

You can challenge the Tribunal's Decision but only on the basis that there has been an Error of Law not because you disagree with the Decision, it's not a quick process, it could easily take the best part of a year and even if allowed there is no guarantee that you would receive an award. As you have access to Welfare Rights I would discuss it with them.
And/or you can make a new claim for PIP, there is no waiting period and it does give you the opportunity to start with a clean slate. Claims are currently taking around 16 weeks at the moment.

kelly im in the same boat - not good for you but some similarity in my appeal - read my post - im considering putting in new claim as the upper tribunal seems so long as this has already consumed my life and my health for the past year
i am considering putting in a complaint about the way the judge handled my case too to the tribunal complaints process..not that it will get me any resolve but i felt so mistreated
