DLA stopped, need to report it to anyone? was created by Carolkitty
Hi, my DLA has been stopped (told to claim PIP) do i need to report it to anyone? Eg change in circumstance?

Dont fully understand all the different departments involved, i get confused.

Im on ESA, so is this the job centre or is it DWP? Or same thing..
Need to report it to ESA department?

And the Council?
I claim housing benefit and council tax benefit.
Council tax support has automatically been reduced after DLA stopped and they said they already know about DLA stopping thats why i need to pay some council tax.

Is council tax department same as housing benefit department?
If not, i need to report the DLA stopping to housing benefit department?

Forgive me but I am a little confused by your post.

You say you have been invited to claim PIP, if this is the case the your DLA should remain in payment until four weeks after a Decision is made on your PIP claim.

If the claimants does not make a claim for PIP within the required timescale then their DLA payments will be suspended and if no claim is made within a further four weeks then the claim will be closed. However, there is nothing in the OP's post to suggest that this has happened, we need them to provide additional information.

yeah the PIP claim is in motion and was refused it after medical assessment, all deadlines and requirements were adhered to.

The DWP should notify all of the other departments but this does not remove the requirement on you to do so, so I would write to each benefit office and make them aware of the Decision.

If you have not been awarded PIP or the award is not what you expected then you need to look at the next steps and whether you want to pursue them or not.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
