ESA, Industrial Benefits, DLA question was created by andreasmith500
Hi
I was wondering whether my benefits for DLA, Industrial and ESA (support group) be affected if I notify them that my partner will be moving in. If so, in what way. I look forward to hearing from you

Hi and Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Welcome to Benefits and Work

In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ

My full name is showing, how can I stop it?

There are 2 issues - firstly whether your benefit is income-related and secondly whether this changes your care needs in any way.

Your DLA is certainly not income-related and I don't think your Industrial injuries award is either (we don't actually deal with this award on the forum). ESA is a different matter as it can be either contributory or income-related. Even more confusing, it can also be contributory with an IR top-up!

Any income-related benefit takes into account your joint income/assets. IR ESA also looks at whether your partner works for 24 hours per week or more.

If you are not sure about your ESA status you should inform DWP anyway, to be on the safe side. We always suggest that you make any contact with DWP in writing and keep copies for your own records. You should keep proof of postage/delivery too.

Bearing in mind that DLA is awarded because of the care you need rather than the care you get I wouldn't expect your partner moving in to make any difference. However, you are the only person who knows for sure!

If you have any further questions about this, please reply to this message rather than starting a new topic - you will find it easily in future if you bookmark/favourite it on your web browser now :)

DLA and IIDB should not be affected.

If your ESA is Contribution Based only then it will not be effected, but if your receiving Income Related ESA in part or in whole then it will become a couples claim and your partner's income, assets and savings and any hours that they work will be taken in to account. See

Asset rule for ESA(IR)

24 hour work rule for ESA(IR)
