On the 21st Nov I won my ESA tribunal appeal and was wondering if anyone has any idea how long before the DWP reinstates the full wrag rate. I received a payment today but that was still at the assessment rate. As it's income related ESA, will I get back payment from the date the original ESA was stopped ? I had to go on JSA for a couple of months, will that affect any back payment ?

It can take DWP up to 8 weeks to actiopn an appeal decision, even when they are not considering taking things further. Claimants can sometimes speed this up by sending DWP a copy of their decision letter.

You will get backpayment from the date payment was stopped - although you cannot be paid twice for the same period so any JSA payments will be deducted. Payment aslo depends on the period being covered by a fitnote.

If this was a new claim you will get the WRAG top-up from the start of the 14th week of your claim and basic rate up til then. If it was a reassessment you will get the WRAG component throughout.

When I spoke to the DWP they told me to ring up if I win my appeal as it can take a long time for the information to be related back to getting your ESA payments back to normal.

You have nothing to loose by ringing the normal DWP number, tell them you have won your appeal and ask how long it will take to get things updated and if there is anything they can do to speed up the process.

I think you will find this is quicker than waiting.
