PIP TRIBUNAL REFUSED...HELP NEEDED was created by Ann jenkins
Hi everyone...advice needed please

I have had lyme disease for 20 years..16 years misdiagnosed...very ill..diagnosed fibro me ms..on my 3rd application for pip..1st 2 0 points and not well enough to take further..3rd app 6 points daily living 8 mobility..applied to tribunal {paper as not well enough to travel} but refused...before tribunal call from dwp to say they could offer 2 extra points for daily living making 8 standard living as they had made an error...said i wished to clam for additional points for mobility so went to tribunal which has been refused..note on papers for tribunal from dwp.."i would recommend that this discriptor is changed from 5a to 5b"...spoke to dwp who state they cant go against tribunal decision...what to do next??...any help appreciated...thanks

I am afraid there is nothing to do about this, the Tribunal has made a new Decision on your claim, if they believed you should have scored the extra two points for Daily Living then they could have made an award on that basis, as they did not the DWP are not obliged to make their original offer again.

You can pursue the Decision to a higher court, but this is not a quick process and you cannot appeal further because the Decision is wrong but only on the basis that an Error or Law was made in the making of the Decision.

If your conditions have deteriorated since the original Decision and you have medical evidence to support this them you can ask for your claim to be reassessed, but you need to be aware that this would a full review of your claim, new PIP2 and almost certainly a face to face assessment.
