Should i Appeal ? was created by WishPositivity
Hi all ,

sorry if this is long i just dont know what to do anymore,
id appreciate any help anyone can give ive typed out the DM reasons for the unchanged mandatory reconsideration

DWP DECISION
"Your needs vary" - my decision is based on help you may need most days
"You didnt declare any functional impairment that causes you difficulty"

"No problem walking and putting on coat and off again and retrieving and identifying medication"

(i put in my letter i NEVER took off my coat even though it was summer and when the woman asked me for my coat i said NO im VERY self coincous so i keep my coat on all times and i NEVER identified my medication i just handed her the folder my carer gave me)

"You coped well at the assessment with adequate eye contact and no signs of anxiety"
(i cant make eye contact with ANYONE i dont know this problem ive had even as a child as this was an isses when i was younger and pointed out to my mother by her friend of 20 years and whom i seen a few times a week when she called to visit my mum she said "its weird how she still doesnt make eye contact with me even though i watched her grow up" , i was that bad when younger) , (i also was crying and blubbering and shaking , had to take my ventolin inhaler twice she could even hear me rasping when i breathed) .

"You had no difficulties expressing or understanding verbal communication and no support was required to answer any questions asked"

(Clearly ignored my letter stating how i was late and the phone call made to the assessment center my carer rung saying we were late proved how she didnt do a full assessment and also how i cant do unfamiliar journeys i had to stop 3-4 times because it was 40 miles away and i was already distressed ) also (i had to pause before answering and also she was annoyed i asked her 3-4 times to say it again).

"you were able to drive a car which shows good cognition and drove yourself to the assessment"

Again clearly ignored my letter stating that i attended the assessment with my carer and me stopping a few times , and also stating that i DONT drive about i ONLY drive to appointments without the car i wouldnt have gone to as many appointments and also i DONT drive if ive had a panic attack or are serverly distressed and i also sent in information from the DVLA website saying about depression and anxiety and that if i was taking anti pschotic drugs then i would not be able to drive , all this was ignored .

"This is consistent with your medical history, informal observations and face to face consultation, how you engaged with the assessor ,the available evidence and your mental state examination results . i cannot consider any help you need not covered by the activities for daily living and mobility"

Can anyone advise me wether its worth me appealing im so drained by all this and having to live in my house where i cant afford heating its freezing ive been that low i havent got out of bed
thanks

As you did not receive an award you have nothing to lose by making an appeal providing you can manage the physical and mental effort of doing so.

Whether you are eligible to receive an award or not is difficult to say, even with your post, as most of the issues that it raises and that you counter and not really specific to the PIP activities.

I would that you request a copy of the assessment report, you should be able to do this by contacting the DWP office dealing with your claim, the address will be on the Decision Letter that you have received.

Once you have this, go through your PIP2, the assessment report and PIP Claim guide to make sire that you have shown that you meet the criteria to score points. You should pay particular attention to the use of "reliably" and "on the majority of days".

The PIP MR & Appeal guide has links to the SSCS1 form that you will need to complete if you decide to make an appeal and instructions on how to complete it.
