Appeal for dla was created by maria
Hi I am receiving carers allowance only recently for my son who has autism. I also am in receipte of dla for myself as i suffer depression and anxiety for years. My dla is now up for renewal. Am i still able to apply if I am in receipte of carers allowance for looking after my son who is 4 years old and lives with me 24/7? Thank you

Being in receipt of CA does not prevent you from re-applying for DLA, although any caring responsibilities that you have which are at odds with your limitations in regard to DLA, may affect your claim.

You say your DLA is up for renewal;

If you are on the UK mainland and you were under 65 on 8 April 2013 then I would expect you to be invited to claim PIP instead of DLA, you should have/will receive notification of this about 20 weeks before your current claim ends.

If you were over 65 then it will be a DLA and you should receive the renewal forms about 13 weeks before the end of your current award.

If you are in N. Ireland then the rules are different.

If your current award ends within the next 20 weeks then I would expect you to receive a DLA renewal, if it is more then it will probably be PIP.

Bottom line, if you are within any of the periods mentioned above and you have not received paperwork from the DWP, then please chase them about it, we have seen the forms for a number of DLA renewals go missing or not even being sent.

Thanks for your reply, yes i am in Northern Ireland and they sent me the renewa; form a few months ago. Will dla get my renewal form from me will they cross reference everything in it with carers allowance? Thanks

They will be aware that you are receiving Cares Allowance so it is possible that you may be asked about your caring activities during an assessment. As an example; if you prepare and cook meals for your son but then claim that you cannot do this in regard to your DLA claim, then red flags will be raised.

To be clear, many people receive DLA and pride care to another person you just need to make sure that there are no contradictions in your doing so.

Hi please can you advise. My renewal for my DLA has been turned down. I was receiving DLA for depression, anxiety and panic attack. I requested a copy of my GPS medical report which states that I have severe depression anxiety and have had a traumatic past. She also stated that I will be a very difficult patient to cure. Since my last DLA my medications have been changed to more stronger and I have been referred for cognitive therapy. I do not understand why they have turned me down. One of the questions asked about effects of condition on day to day life such as self care and awarenesses to danger in which my GP answered independent and aware. Could this be why they turned me down as I feel everything on the report states how bad my depression and anxiety is. Would i have a chance if I asked for reconsideration? Thanks

Hi Maria,

I'm sorry that your DLA reassessment decided that you are not entitled to the award :( We don't see people being reassessed for DLA much now, were you over 65 in April 2013?

Without knowing what you have written on the form, I cannot know whether it was your GP's comments that caused the problem. It is possible that this is to blame if it is clearly at odds with what you have said about your problems.

I'm afraid that we don't often see MRs change the original decision but it certainly does happen. Have another look at our DLA guide to see whether you could have described your problems differently.
