thank you mrs hurtyback for your reply.

i am a bit confused now. `daily living ` is every day, so if i struggle and need help to carry
out these activities on my going days but cannot carry out these activities on my bad days, surely they must take the bad days into consideration ?

They will take the bad days into consideration but your carer appears to have told them 2-3 days without any qualification of how you are on the other days. If you did not specify this in your PIP2 then you will have to explain from scratch, however, Decision Makers are loathe to take a second explanation of a claimants problems as being correct, they take the view that the first explanation is always the most accurate. An appeal panel may take a different view to the DM.

To be clear, to meet the requirement for the majority of days, any day that you cannot reliably complete an activity should be included. So a claimant who cannot complete the activity at all on the two days of the week that they are "bad" and cannot reliably complete the activity on the four days a week that they are "average", but could complete the activity on the one day a week that they were "good", would meet the requirement as they cannot reliably complete the activity six days out of seven.

i was on hrmc and low care rate, now on standard rate mobility. i also have done the same as you. i rang DWP the other day to see if my letter had arrived, as it has now been two weeks. i was informed that my letter had arrived and it is sitting on a desk, the lady informed me that, she would chase it up for me. I lose my car this month and won't be travelling anywhere now, as i am unable to reach the bus stop and train station.
