ESA when to apply was created by Flavia
My friend is losing her job. She's being paid off for lack of capability due to ill health. She's 61 and not disputing this. She would like to apply for contribution based ESA. She's been told she'll be given 11 weeks pay for her years of service. Can she apply for ESA straight away or would she need to wait til those 11 weeks were up.

Hi Flavia,
Your friend can apply for ESA once she is no longer getting Statutory Sick Pay.

Thank you but she hasn't been getting SSP. Her work paid her while she was sick but the employment ends on Tuesday. Is there something she needs to do before applying for ESA?

No, she can phone up straight away and initiate the claim, as long as she makes it clear that she will still be paid until Tuesday. It is not the employment that is the problem - many people are on ESA who still have a job waiting when they are able to return.
