I previously posted a thread on the subject of my nephew having his PIP withdrawn. His previous DLA was higher rate on both Living Allowance and Mobility Allowance. I asked for the case to be reviewed. That was rejected and the decision remained the same. Now I have to appeal. So not knowing where to start. I have asked for a copy of the assessors report. This has not arrived so that is the first thing I need to obtain.

I have an appeal form. which of course I will fill in, but then I am in the dark. I do not need to hold up that form until I have all the relevant information. At the time of submitting the form what other information do I need to send with it. I can say goodbye to a tranquil and restful Christmas and I suspect the appeal is going to take up all of my time and energy. I am helping my nephew as he does suffer from dyslexia, He is astounded at the decision and convinced its because of his age and he has managed to get a job. He managed to get the job purely because he had the extra support, mobility etc to enable him to get to and from work, etc.

People can be disabled and be a valued member of the community and not have to claim other benefits because he has actually done what the government has pushed for getting a job.

so am I doing this right

1.Fill in appeal forms - inform that information will be forwarded to the appeal once it is obtained.
2.Write to the DWP asking for a copy of the Assessors report.
(give 7 days to respond)
3Collate and write appeal - reasons, basis, evidence etc.

Can anyone tell me how long it takes to get an appeal hearing. Do I have to pay any expences. Do I have to inform the APpeal of who will be attending at this point..

The PIP Appeal guide explains how to complete the SSCS1 form and also explains the appeal process in detail.

Once your form has been accepted by the Tribunal Service, they will send a copy to the DWP for them to prepare their submission, this will include all of the documents used in the making of the Decision, so you can request them now, I'm afraid your request for this to be done in seven days will be ignored, or you can wait for the DWP bundle to be sent to you.

I would recommend that you do not send the TS your detailed reasons for the appeal until you have received and read the DWP submission to ensure that you can cover all of the issues that they might raise.

Appeal times are variable by area but typically a hearing will be 3-4 months from when you make the request.
