Already have PIP now claiming ESA was created by Ikcdab
I am supporting a young man (he's 24) through these processes. He has learning difficulties.
We successfully applied for PIP and this was granted. it has a 10 year review date. So we are pleased with that.

We are also applying for ESA. We are having the face to face on 9 January. I will be taking him and probably answering most of the questions as his communication skills are poor.

So, will the ESA decision maker revert back to the PIP documentation and the decisions made there? I realise that the two benefits are differently focused but there obvious overlaps and the fact that he's been given PIP for 10 years must be an indicator. If they don't look at the PIP stuff, then should I mention it?

Second question, I omitted to keep a copy of the ESA50 form. If I ring up, do you think they will post a copy back? I know I can ring and ask, but I'm not sure I can face the hanging on....

Many thanks

Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Welcome to Benefits and Work

In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ

My full name is showing, how can I stop it?

Although there are indeed overlaps between the two benefits there are still considerable discrepancies in the assessment criteria, so whilst a PIP assessment report can be supportive of an ESA claim it's not a given.

I'm afraid you can't assume that those assessing this young man will have access to the report or even if they do that they will use it so if you want it to be considered then you need to submit a copy, you can send a copy to Maximus at the same address as the assessment. For it to be effective you really need to explain why relevant sections of the PIP report apply to the ESA activities.

As to the ESA50, contact the DWP office dealing with his claim, they should be able to get a copy.

Thank you for the helpful reply. The claim is based on learning difficulties and lack of communication and social skills. This is a young man who is isolated from society. He is unable to make social contact and his learning difficulties mean he has great difficulties learning new skills. Although he is 24, he has not had a meaningful job since school. All of this is covered on the pip decision letter so I hope to be able to use it as evidence.

Do you mean I should post this off to the assessment centre prior to the face to face or take it on the day?

Both, sending it now could mean that a face to face is avoided, taking it on the day makes sure that the assessor reads it.

Thank you for your reply. I therefore intend to write a letter along the lines of:

I am supporting this young man. I am aware that the assessment centre only has the ESA50 form and a doctors letter.
He was awarded PIP and the report has evidence to support his ESA. I enclose a copy of the report.
ESA Question 11: i believe that the comments of page x of the report support this question because.....
ESA Question 12: ditto.
etc.

I have begun to draft this letter.

I am aware that although the assessment centre may not (yet) have the PIP report, that the DM will indeed have it when making the decision.

I cannot see a downside in doing this letter and would be grateful for any feedback.

Many thanks
