esa support group to wrag re:N.I.payments

Hello guys - thanks for your sterling work.
I have looked in FAQ but can't find answer to my query:

1) If in Support Group ESA (contribution based) and after re-assessment was put in the WRAG (which would be appealed) would payment immediately cease if you have been in support group for longer than 365 days ?

2) If put into WRAG group or indeed no ESA group ( once again it would be appealed) and you declined attending work focussed interviews or activity would you only have N.I. contributions paid?

3) If either of these scenarios occurred and you had more than 35 years of N.I. contributions paid to qualify for full State pension what would the effect be if no further N.I. credit was being paid ?

1. Time spent in the SG does not count towards the 365 days, so if you were not in the WRAG previously then you would have the full year available.

2. ESA pays NI Credits not Contributions, as long as you continue to receive ESA you will receive the Credits.

3. Impossible to say, under current legislation 35 years should be enough for a full State pension but if the rules are changed again then it might not. You can get a statement from the DWP on what pension you would receive.

Thank you Gordon.

Sorry but what is the difference between NI contributions and NI credits please?

Also if you have the required amount as it stands (i.e. 35 years) what would the extra years contributions be needed for?

Finally - if you have the required amount of years contributions ( and/or credits?) would you still have to attend work focused interviews?

Sorry to bother you on this but I rarely post but really need to clarify these things in my mind.

NI Contributions can only be acquired through the person working, either as an employee or as self-employed. Contributions count towards a full State Pension and allow the claiming of Contribution Based benefits such as ESA(CB).

Credits are paid as a result of a claimant receiving certain benefits such as ESA. Credits count towards a Full State Pension, they count in part but not in whole towards the claiming of Contribution Based benefits.

There is no additional value in receiving Contributions or Credits once you have sufficient years for a Full State Pension, however, I would check that you have actually got the necessary years before considering any further action.
