How long to make a decision from dla to pip

Hi i am asking this question on behalf of my brother. He filled in the initial form from moving from dla to pip on the 10th November 2015. It went to an appeal as he lost all his money. The appeal awarded him the lower rate for personal care but he still lost his mobility he decided to accept this as he could not go thru anymore.
The DWP have decided to go to an Upper Tribunal this is now January 2017 with still no news i was just wondering if anyone else has had this and knows how long it takes.

If permission has been/is granted to go to the UTT then I'm afraid it could take a year or more for this to be decided

Meanwhile, if your brother has no PIP award, he can reclaim immediately if he wishes. If he does this, the eventual decision on the first claim would only run until the date of the decision on the new claim.

Hi maybe someone could help my brother received a letter regarding his case going to Upper Tribunal. The letter asked if he would be representing himself or appointing a solicitor.

He is a bit confused as he thought the upper tribunal was now between the tribunal judge and the Dwp as dwp are arguing a point of law.

He could not represent himself at his appeal his sister went with him for support.But a upper tribunal would be outwith their knowledge

The letter advises him to get a welfare officer or a solicitor who could understand the point of law. He has 14 days to reply to the letter.

The DWP will be arguing a point of law but your brother should be represented by someone who understands the laws involved and can counter these arguments on his behalf.

Subject to financial assessment, legal aid is still available for Upper Tier Tribunals.
