PIP Review Consultation Report

Hello, my standard rate of care has gone down by 8 points to zero, even though I stated on Change of Circumstances that my health has worsened. On the Consultation Report on the first page under the heading '[List all evidence considered alongside the consultation findings', where medical evidence is inserted, I am concerned that also listed is the complaint letter that I sent in a year ago re. HP and also the letter 'stating I was not happy with the decision (this was my Mandatory Reconsideration Letter). Surely this is irrelevant and could potentially deter claimants from making a complaint or Mandatory Decision if they feel it would potentially be used against them further down the line. Is this legal?

I think it is probably legal for DWP to use any/all paperwork they already hold relating to your previous claims. However, I do agree that it does not seem fair - for the reason you state.

I suggest you contact your MP to let him/her aware of how claimants are being treated
