Question for Gordon or Miss Hurtyback

I have got my appeal papers back from the DWP

Now they change to 11 points and 16 points from saying I would get NOTHING !

1 point off but still going ahead with appeal, these are from the dwp pack to the court.

Am astounded they have only given the bare minimum or lowest points they could and i should get a few more points.

So they have put they are now not arguing about the mobility and believe 16 points is correct
so I guess i don't have to fight that now.

I used to get a severe disablement premium. The info on the DWP site is not up to date and deals with income support and not esa. I do not know whether i have to get a high score in one or of so which one, to get the £60 a week plus i used to get before

ALSO will the DWP still look at this a week before the date of hearing, I don't know why they are
only given me 11 points. But then again, for months i had, 0 then it went to 4 points, now its 11
its like they just denying me it because its more money because of this premium they will have to pay me.

I won't be settling the case with them now only for 2 highs and am 99% there !

Hoping this will all end soon in a good way.

You need a Daily Living award for SDP, it doesn't matter whether it is Standard or Enhanced.

The DWP should look at your appeal documents in the week before your hearing, but with no further evidence or testimony I think it unlikely that they will change their current "offer".

Thank you for confirming I will get the SDP with low or high care component.

Having gone through the points awarded and the definitions in the Excellent downloadable guides you get access to as a member of the site, there is only 1 area where I would get the extra point needed.

This is question 3 Managing Therapy or monitory a health condition.

The DWP has awarded b to use an aid or needs supervision prompting.
This carries 1 point.

ON MY APPLICATION I Indicated between c or d which carries 2 to 4 points.
This is also the reality and truth so answered correctly.

My medical report from care co ordinator gives a serious account of problems I am having but does not mention the 3.5 hours a week, though am unsure as to how that can be timed accurately.

YOU MENTIONED FURTHER MEDICAL EVIDENCE before the Appeal date gets looked at again. If I can ask my councillor to be more specific about length of time in the prescriptor.
ie. prescriptor C which would then push from 11 points to 13 points, would this be considered before the appeal date ?

Because I am considering my options now seriously and my mental health team are also ringing me later, would this not be the best course of action to get the award raised also then I believe it would be accurate and true after all this time.

Thankyou for your help, which I hope now is the last HURDLE of a long long process.

You should not be sending anything directly to DWP at this stage, all communication should be via the TS.

I don't know the date of your hearing or whether they would, realistically, be time to get anything to TS and then DWP before the hearing. If you can, there will be no harm in doing so.

You can still provide evidence on the day, if essential. You should ensure it is no more than 1 A4 sheet and you would need to hand 6 copies to the Clerk of the Court when you arrive.

To clarify I have not yet received a court date but expect this to be soon and I have asked for a minimum of 14 days notice.

Since reading Gordons reply, I have now arranged for my mental health team to provide further clarification in more details and how many hours I need for question 3 rather than general statement. This extra medical evidence I am assuming will either be looked at as soon as the DWP receives it or when they review the case before the appeal.

I am only 1 point short and the medical evidence if changed with give me 2 points for this question or 4 points depending how they mark it.

TRIBUNAL : If they don't change their decision and i have to go to the tribunal, because the DWP has written in the court documents that they have awarded me 11 points and 16 points, that the tribunal will only look at the one question I am disputing or have to go through everything from scratch ? That seems a waste of the courts time if the DWP are saying they have awarded me those points.

Final Guidance on this would be appreciated.........Thankyou

The panel are not bound by the DWP "offer" and will make there own Decision.

They may well decide that the evidence presented supports the DWP offer or indeed a higher one, but they may also decide that it does not and you may need to show that you should be awarded more than the one extra point that you are expecting to need at the moment.
