OK Gordon, thankyou for explaining that so I understand it.

This obviously makes the ordeal of attending the tribunal more of an ordeal and longer experience. Having them go through every point.

My immediate plan is to obtain the medical evidence regarding the one question and try and get that looked at by the DWP when they review cases a week before the hearing.

One final thing I could do with understanding, if I decide to accept the offer if they do not change their mind when seeing new medical evidence. Is there a time limit for me having to accept the offer or can i do it at the last minute when i realise the dwp is not going to change its mind when they look at it before the hearing date.

I am assuming that if the date is 7 days away they will not look at it again or should i leave it until 5 days before as i don't want to accept the lower offer for them to change they mind at the last minute.

Hope you can clarify this last point, it would be very much appreciated so I know what my options are.

The appeal can be cancelled at any time up to time it starts, when you should consider contacting the DWP is up to you, but be aware, whilst I've no reason to assume that the "offer" will be rescinded there is still the possibility that the DWP will take the view that they should leave it to a Tribunal to decide.

Thank you for that warning that the DWP can rescind the offer. Thats quite important information. I have since received a letter from my mental health case worker regarding the disputed number of points and just writing to the court now so they can send it to the DWP as I believe that all the rest of the points they have awarded are correct except on this one question.

Having more specific information that you have provided of the possible outcomes makes life a lot easier to decide. However this is my next step as the proof to be sent will give me more than 1 extra point that i need to get to 12 which i allways believed from the beginning was the criteria i have met from the beginning.
