Annoyingly failing my Mandatory Reconsideration from ESA to WRAG which has occurred on at least four occasions. I again have to appeal. It's the stress and anxiety of it all that troubles me, even though to date my appeal has always been upheld (not being present) I have Epilepsy with many disabling factors, and guess from the initial start I am not emphasising correctly my problems. I fail on descriptors.
Can you please advise, does the appeal to the tribunal have to be hand written or can it be typed. Also I will be going away for four weeks at the time of posting. Should I advise them of this should I be needed by letter or phone? I feel it just does not sound very good, fighting a battle for ill health and not being available for four weeks?

You need to use the SSCS1 form, there is a link to it in the ESA Appeal guide.

You could attach your reasons for appeal as a typed page.

How often do you have an attack? You will need to have a seizure at least once a week to qualify through a Descriptor, otherwise it will have to be either Regulation 29 or 35 due to risk of harm.

Hi Ginny,

Do let them know about your absence as I think you can be away for up to 28 days. (this is what I was told at the JC during my visit as I'm moved from SG to WRAG) there is apparently a form for you complete if you are going away too. Please put your appeal in with your reasons because if you miss the deadline they may not accept your appeal. Also do let the Job Centre know so you don't miss your visits this will prompt another letter coming out telling you that you may lose the ESA benefit or cut your benefit, I had similar issues in November please do read my posts I am sure the lovely helpful moderators will advise you more
