UPDATE
After lodging an official complaint it has been decided that my DLA was stopped prematurely and has been reinstated with backdated money to be paid and to continue untill a decision is made on my PIP claim which was referred back to AP (ATOS) over 3 weeks ago I'm still awaiting the result. Unfortunately I had to give up my Tax disc and change my V5 log book back to PLG from Disabled class at a cost of £129+. I've also had to give up my Blue Badge and now pay for parking. These should not have happened and now have suffered loss especially the cost of obtaining a new Blue Badge. I think I will wait untill I receive my PIP decision before I decide my next step.

Well at least it is a step in the right direction.

Do you know if the DWP made a request for a home visit when they referred it back to ATOS.

ATOS refused to do an home visit due to my mental health issues. Apparently they are going to do a paper based assessment now that they have realised I cannot attend their assessment centre due to my health issues thanks to a GP report that was first ignored and then accepted. I cannot understand why they are reluctant to follow the law and not implement regulation 9(1)(a) but that's one for the appeal if needs be.

On the point of a home visit my my wife applied for PIP in 2014 and in her claim pack asked for an home visit and got one no problem at all. Mind you it took just over two years and three tribunals one an upper tier tribunal for her to get PIP. The upper tier tribunal judgement was interesting reading regarding my wife's dislexia and the way an ATOS nurse rubbished her GPs report.
